These Terms of Service ("Terms") are a binding agreement between you and Nostelia ("Nostelia," "we," "us," or "our") governing your use of the Nostelia mobile application and related website at nostelia.vercel.app (the "Service").
By creating an account, joining as a guest, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
Nostelia helps you create and share personal memory chapters, including photos, people, locations, and collaborative access via invites and QR codes. New uploads are photos only.
We may change, suspend, or discontinue features at any time. The Service is provided on an "as is" and "as available" basis.
3. Accounts and security
A. Registration
You may register with email and password or supported sign-in methods (such as Google). You agree that your registration information is accurate and kept current.
B. Your responsibility
You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at deccoo.prog@gmail.com if you suspect unauthorized access.
C. Guest access
Guests may join chapters through invite links or QR codes. Adding photos requires a free Nostelia account. Guest access is subject to chapter owner settings (including approval) and these Terms.
4. Your content and license
A. Your content
You retain ownership of content you submit ("User Content"), including photos, text, names, and avatars.
B. License to Nostelia
You grant Nostelia a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and process User Content solely to operate, provide, secure, and improve the Service, including making content available to people you invite or who join your chapters according to your settings.
C. Your promises
You represent and warrant that:
- You own or have all necessary rights and permissions for User Content.
- User Content does not violate law or third-party rights (including privacy, publicity, and intellectual property).
- You have obtained any required consents from people identifiable in photos you upload.
5. Acceptable use
You agree not to:
- Upload unlawful, harmful, harassing, hateful, exploitative, or sexually explicit content, especially involving minors.
- Impersonate others or misrepresent your affiliation.
- Use the Service to spam, scrape, reverse engineer, or disrupt systems.
- Attempt unauthorized access to accounts, chapters, or infrastructure.
- Upload malware or interfere with security.
- Use the Service for commercial solicitation without our written permission.
We may remove content or suspend access if we believe you violated these Terms or applicable law.
6. Sharing, invites, and collaboration
A. Your controls
Chapter owners may set join policies (such as public join or owner approval). You control invite links and QR codes you share.
B. Your responsibility
Anyone with an invite link or approved access may view or contribute content according to chapter settings. You are responsible for who receives links and for content shared in your chapters.
C. Public media URLs
Media may be stored with URLs that can be accessed by anyone who has the link. Do not share sensitive content if this level of access is unacceptable to you.
7. Other people's information
If you add names, photos, or other information about other people, you confirm you are allowed to do so and, where required, have informed them and obtained consent.
8. Intellectual property
The Service, including software, design, branding, and documentation (excluding User Content), is owned by Nostelia or its licensors and protected by intellectual property laws. You may not copy, modify, or create derivative works except as permitted by law or our written consent.
"Nostelia" and related marks are our trademarks. Do not use them without permission.
9. Third-party services
The Service relies on third-party providers (including Supabase and Google sign-in). Your use of those features may be subject to their terms and policies. We are not responsible for third-party services outside our control.
10. Privacy
Our Privacy Policy explains how we handle personal information. By using the Service, you consent to our data practices as described there.
11. Termination
You may stop using the Service at any time and may sign out in the app.
We may suspend or terminate your access at any time if we reasonably believe you violated these Terms, created risk, or if required by law.
Upon termination, your right to use the Service ends. Sections that by nature should survive (including licenses granted for content already shared, disclaimers, limitations of liability, and dispute terms) will survive.

12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT CONTENT WILL BE PRESERVED INDEFINITELY. YOU USE THE SERVICE AT YOUR OWN RISK.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOSTELIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50 (OR EUR €50).
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, THE ABOVE LIMITATIONS APPLY ONLY TO THE EXTENT ALLOWED BY LAW.
14. Indemnity
You will defend, indemnify, and hold harmless Nostelia from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.
15. Dispute resolution and governing law
These Terms are governed by the laws of [GOVERNING LAW], without regard to conflict-of-law rules.
You agree that disputes will be brought exclusively in the courts located in [COURTS LOCATION], unless mandatory consumer protection laws in your country require otherwise.
If you are an EU consumer, you may also have rights under mandatory local consumer laws.
16. Changes to Terms
We may modify these Terms at any time. We will post the updated Terms at nostelia.vercel.app/terms and update the effective date. Material changes may require additional notice where required by law. Continued use after the effective date constitutes acceptance.
17. Miscellaneous
- Entire agreement: These Terms and the Privacy Policy are the entire agreement regarding the Service.
- Severability: If any provision is unenforceable, the remainder remains in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger or sale.
